The Central Bureau of Investigation (CBI) has moved a Kolkata court seeking permission to conduct a narco analysis test on Sanjay Roy, the accused in the RG Kar rape and murder case, said an official familiar with the matter.
Roy was produced before the additional chief judicial magistrate court for his consent on Friday. A closed-door hearing was held.
In 2010 the Supreme Court had imposed some restrictions on conducting narco analysis test and ordered that the tests should not be administered without the accused’s consent.
Although narco analysis generally does have legal validity, the court may grant limited admissibility after considering the circumstances under which the test was obtained.
People familiar with the matter said that Roy was explained the whole process during the hearing. His counsel was present.
CBI has already conducted polygraph tests on Roy and a few other persons in this case.
A 31-year-old trainee doctor was allegedly raped and murdered at RG Kar Medical College and Hospital on August 10. The next day, the Kolkata Police arrested Roy and named him as the prime accused. Roy, however, has been claiming that he was innocent and was being framed.
On August 23, the Calcutta high court handed over the probe to the CBI.
